Serbia adopted a new law on 22 November 2011. Recently, the Serbian Gaming Board made an additional, very controversial move: it sent an order to all major Serbian Internet Service Providers (ISPs) demanding them to block the sites of 70 foreign gaming operators including
www.partybets.com. This is the third attempt of the Serbian Gaming Board to send such order to the ISPs – the previous two failed. And this one, the third one, merely seems to be adopted by State-owned ISPs. Following legal opinions and even according to representatives of the Serbian institutions it seems that the current provision of ISP blocking is not in compliance with fundamental, constitutional guarantees.
Article 50 of the Constitution of the Republic of Serbia provides that the Freedom of the Media shall be guaranteed and explicitly prohibiting censorship, while the current provision of ISP blocking falls within the term of "censorship". Furthermore, the ban of the websites can only be implemented after a national court's decision outlining explicit grounds of public interests. To our knowledge, no such decision has been issued so far. It is highly doubtful whether the Serbian Gaming Board would de facto enforce the ban through court or – even more doubtful – if a Serbian court would issue such order.
